    How are they going to do that if they are kidnapped and extreme renditioned to some concentration camp in another country?

    So out of touch.

    Majority of Americans do not have the finances, free time and connections to sue anyone they please. Not to mention, why are private party cases the solution to state actions?

      Right. And even if we did all have civil rights lawyers on retainer, it still would not matter. The courts have decided that in almost all circumstances, federal agents have immunity for their actions, no matter how horrible. Torture? Assault? Sure thing, it’s all covered, your lawsuit will fail.

      Heck, your lawyer already knows it will fail, so they won’t even file it.

      That’s reality. There are no checks on federal agents, unless it’s identical to the one single case on file, Bivens. So you gotta pray that you live in Brooklyn and the Federal Bureau of Narcotics raids your house without a warrant. If that’s you, then you will win your lawsuit. Any other situation and you’re just fucked.

      I think that is infact why he said this, also there is always going to be him saying no to all of it and wasting all that money. (i.e. soon to be the courts slush fund)

        Doesn’t matter. The courts have already granted the feds immunity for everything except for cases identical to Bivens. File as many lawsuits as you want, and you’ll just waste money on legal fees before losing them all.

    Come on Brett, you’re the fucking Supreme Court, are you that dense not to know the whole thing is a Fourth Amendment violation of the constitution, not just when the enforcement actions are violent? The lower courts had it all teed up, did their job and now you have perverted the concept of equal rights and freedoms for racialized minorities, all in a 10-page thing a couple second year law students could have written.
